Terms of Service
The agreement between you and us: what you can send, what it costs, and who is responsible for what.
Effective August 17, 2026 · Last updated August 17, 2026
1.This agreement
These terms are between you and [the registered company name], [the entity type and state of formation] (“we”, “us”), and cover your use of HomeDrop Mail. By creating an account or sending mail through the service, you accept them. If you are accepting on behalf of a company, you confirm you are authorised to bind it.
You must be at least 18 and using the service for business purposes. The service posts mail within the United States.
2.Your account
Keep your sign-in email secure. Anyone with access to it can reach your account and spend your credit. You are responsible for what your team members and your API keys do. Tell us at support@homedrop.io if you think someone has got in.
3.Subscription, credit and payment
There are two separate charges, and they work differently on purpose:
- The subscription pays for the software. It renews monthly until you cancel. New accounts get a 14-day free trial; we take card details at the start so sending does not stop the day the trial ends, and nothing is charged if you cancel before then. Promotional codes apply on the terms stated when they are issued.
- Credit pays for the mail itself: printing and postage, passed through rather than marked up. Credit is deducted only when a piece of mail is actually sent.
Credit terms
- Credit can only be spent on mail through this service. It has no cash value.
- Credit does not expire while your account is open.
- Unused credit is refundable on request to support@homedrop.io while your account is in good standing. Credit already spent on posted mail is not refundable, because the mail exists and the postage was paid.
- If automatic top-ups are switched on, we charge your saved card the amount you configured when your balance falls below your threshold. Turn it off any time in billing.
Failed payments
If a payment fails we will tell you and pause sending rather than post mail you have not paid for. We may suspend an account whose subscription is unpaid. Prices may change with 30 days’ notice, effective at your next renewal. Amounts exclude taxes, which we add where required.
Cancel any time; the subscription runs to the end of the period you have paid for and is not pro-rated.
4.Mail cannot be recalled
This is the most important clause in this agreement. Once a piece of mail is submitted to the printer, it cannot be cancelled, edited or recalled, and the credit it used is spent. A typo, a wrong address list, or a campaign aimed at the wrong neighbourhood is a real letter arriving at a real house.
The service is built to give you the chance to catch that: previews, an approval step, and a hold on anything that looks unfinished. You are responsible for using it. Check the recipients and the message before you approve.
We do not guarantee delivery, delivery times, or any particular response rate. Post is handled by third-party printers and by the postal service, and some mail goes astray.
5.What you may send, and to whom
You are the sender. The mail is yours, the list is yours, and you are responsible for both. You confirm that:
- You have the right to contact every address you upload: that you obtained the list lawfully and are not barred from writing to those people.
- You will honour opt-outs. If someone asks you to stop, stop, and add them to your suppression list.
- You will comply with the law that applies to you: advertising and deceptive-practices rules, postal regulations, and any licensing or disclosure rules for your profession. If you are a licensed real estate agent, that includes your state’s advertising and solicitation rules, and any restriction on approaching homeowners after a sale, a foreclosure filing, or an expired listing.
- Your mail identifies you honestly and does not impersonate anyone, imply an endorsement you do not have, or misrepresent what you are offering.
Not permitted
- Harassing, threatening, deceptive, obscene or discriminatory content.
- Anything designed to look like an official, government, legal or bank communication.
- Debt collection, and offers directed at people in financial distress.
- Content or offers unlawful where the recipient lives, or unlawful to send by post.
- Uploading a list you bought or scraped without the right to use it for mail.
- Reselling access to the service, or using it to send on behalf of a third party without telling us.
We may hold, refuse or remove mail that appears to breach this section, and suspend accounts that do. We do not review content in advance and are not obliged to. The responsibility for what goes out is yours.
6.Your data and your recipients
The addresses and contact details you upload remain yours. You instruct us to process them so we can send your mail, and we do not use them for anything else. How we handle them is set out in the Privacy Policy.
If someone contacts us asking not to receive your mail, we will add them to your suppression list and let you know. You are responsible for handling any request they make directly to you.
If you are subject to privacy laws requiring a data processing agreement with your vendors, ask us at support@homedrop.io.
7.Address data, property data and imagery
Some parts of the service are built on data and imagery licensed from third parties: public address records, property records from a data provider, and map and street-level imagery from mapping providers.
- It is provided as we receive it. Coverage is uneven, records go stale, and some areas are missing entirely. We do not warrant that an address exists, is currently occupied, or is correctly described.
- Third-party terms apply to it, and those providers can change or withdraw access. If a provider restricts a use we currently support, we may have to remove or change that feature, including for work you have already set up.
8.Ownership
You keep ownership of your artwork, your messages and your lists. You grant us the licence we need to store them, render them and hand them to a printer so your mail can be , and nothing beyond that.
You confirm you have the rights to any artwork, logo, photograph or text you upload. We keep ownership of the service itself, and of any templates and sample designs we provide.
9.Availability
We aim to keep the service running but do not promise uninterrupted availability. We may take it down for maintenance, and features may change. Scheduled mail is held rather than dropped when the service is unavailable.
10.Ending the agreement
You can close your account at any time. We may suspend or close an account that breaches these terms, that is not paying, or that is being used unlawfully. Immediately where the breach is serious, otherwise after telling you.
When an account closes, scheduled mail that has not been submitted is cancelled and the credit it was holding is released. Unused credit is refundable under section 3 unless the account was closed for breach. Ask for a copy of your data before you close it; see the retention periods in the Privacy Policy.
11.Disclaimers
To the fullest extent the law allows, the service is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free, that mail will arrive, or that it will produce any commercial result.
12.Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill.
Our total liability arising out of or relating to this agreement is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
Nothing here limits liability that cannot be limited by law, including for fraud. Some states do not allow certain exclusions, in which case those exclusions do not apply to you.
13.Indemnity
You will defend and indemnify us against claims, damages and reasonable legal costs arising from the mail you send, the lists you upload, the content you provide, or your breach of section 5. We will tell you promptly about any such claim and let you control the defence of it.
14.Governing law and disputes
This agreement is governed by the laws of the State of [the governing-law state], without regard to its conflict-of-laws rules. The courts of [the county and state for venue] have exclusive jurisdiction, and both parties consent to that venue.
Before filing anything, email support@homedrop.io and give us 30 days to sort it out. Most disputes are a billing error.
15.General
We may update these terms; if a change materially affects you we will email account holders at least 30 days beforehand, and continuing to use the service after that means you accept it. If a clause is unenforceable, the rest survives. Not enforcing something straight away does not waive it. You may not transfer this agreement without our consent; we may transfer it to a buyer of the business. Sections 4, 5, 8 and 11 to 14 survive termination.
